MEMORUNDUM
To
His Excellency, Mr. Ban Ki-Moon,
Secretary General, UNITED NATONS,
Your Excellency,
India and Pakistan have fought 3 wars in 1947, in 1964 and in 1971 over Kashmir. They were not Nuclear States at that time, but now they are. And India is drumbeating war hysteria to divert attention from daily demonstrations against its occupation in Kashmir.
This situation has raised alarm in the world community. VOICE OF JOURNALISTS has pointed out. “It (Kashmir) has often been dubbed as the nuclear flashpoint owing to the fact that it is a constant bone of contention between the two nuclear states of South Asia; India and Pakistan”. Kashmir issue has the potential to become a flash point for a Nuclear War someday, if this dispute remains unresolved any further. It cannot be kept in cold storage any more, as it had been for the last about 70 years since Security Council passed 2 resolutions in 1948 and in 1949 and UN remained a silent spectator all the time since then, with no concern to resolve this bone of contention.
“The Kashmir dispute dates from 1947. The Partition of the Indian sub-continent along
religious lines led to the formation of India and Pakistan”, wrote daily Telegraph. Voice of
Journalists has called Kashmir issue “the unfinished agenda of the partition”.
We give below a few quotations from the Home Page of PAKISTAN MISSION TO
UNITED NATIONS to throw light on the basic issues of Kashmir dispute briefly. http://www.pakun.org/kashmir/history.php
“India's forcible occupation of the State of Jammu and Kashmir in 1947 is the main cause of the dispute. ….The United Nations also does not consider Indian claim as legally valid. It recognizes Kashmir as a disputed territory. With the exception of India, the entire world community recognizes Kashmir as a disputed territory. “In 1947, India and Pakistan went to war over Kashmir. During the war, it was India which first took the Kashmir dispute to the United Nations on 1 January 1948. ……..The UNSC Resolution of 21 April 1948--one of the principal UN resolutions on Kashmir—stated that “both India and Pakistan desire that the question of the accession of Jammu and Kashmir to India or Pakistan should be decided through the democratic method of a free and impartial plebiscite”. Subsequent UNSC Resolutions reiterated the same stand. UNCIP Resolutions of 3 August 1948 and 5 January 1949 reinforced UNSC resolutions.”
It was on the same principle, as required in Kashmir, that a UN- sponsored referendum was held on 30 August 1999 in East Timore. It showed overwhelming approval for East Timorese independence from Indonesia. UN intervened immediately when a Christian territory asked for independence from a Muslim Indonesia and its was announced on 4 September, 1999 by the UN.
The United Nations Mission in South Sudan (UNMISS) is the newest United Nations peacekeeping mission for the recently independent Republic of South Sudan, which became independent on 9 July 2011. UNMISS[1] was established on 8 July 2011 by United Nations Security Council Resolution 1996 (2011). Prompt attention given to resolve this issue again reveals the biased attitude of the UN towards a Christian territory. South Sudan was hastily separated from a Muslim Sudan. But the Kashmir issue involving suffering of and injustice to Muslims is lingering on the agenda of the UN for the last about 70 years.
We therefore request the UN to adopt the same principle of referendum in Kashmir also, as it has implemented it in the Christian East Timore and in the Christian South Sudan cases and abandon prejudiced attitude against Muslims. We request you not to turn UN into just a Christian Club to save only the suffering Christian population in the world. Such an one-eyed, and devoid of impartiality, Justice of the UN will lead to its failure like that of its predecessor, League of Nations. 56 Muslim States and members of UN and more than one-fifth population of the world consisting of Muslims all over the world will be frustrated and will lose faith in the impartiality of the UN due to such prolonged negligence, if the UN fails to implement its own 70-year old Security Council Resolutions of 1948 and 1949. It should hold a similar plebiscite under its supervision in Kashmir as it promptly held in the Christian East Timore to fulfill its overdue obligation to let Kashmiri people exercise their right of self-determination freely.
It is also an extremely huge unresolved humanitarian issue. Due to the escalation of the Indian Army atrocities and the daily defiance of the curfew by the oppressed people in the Indian Occupied Kashmir for the last over 3 months, this humanitarian problem has become further acute, begging awakening of the UN and the world conscience. If you put the words “Indian Atrocities in Kashmir” in Google Search engine, you will find more than 528,000 entries describing details of Indian atrocities on the unarmed, innocent civilians in Kashmir. More than 100,000 innocent, unarmed civilians have been killed by the Indian Forces since 1947. Curfew has been imposed there since last over 3 months-----longest period in recent history. Those who are alive, their eyes are being blinded. Lot of such videos can be seen on the YouTube abundantly.
All this oppression has given birth to an indigenous Freedom Movement in Kashmir. It is becoming stronger day by day. All European Great Powers had to abandon their colonies in Asia and Africa in early 20th Century. Humanity was rescued from the clutches of Imperialist Powers. We feel it is the obligation imposed on the UN to help the innocent and armless civilians and to rescue the people of Kashmir from the imperialist clutches, oppression and suppression of India and to put an end immediately to the massacre and atrocities of Indian Army since last 70 years and from its recent limitless escalation.
